7. Grievance and Disciplinary

Disciplinary and grievance procedures help to promote fairness and consistency in the treatment of staff in the workplace.

The rules outlined in your disciplinary policy will tell employees what behaviour employers expect from them. If an employee breaks specific rules about behaviour it is classed as misconduct. By establishing the company expectations, all staff will be aware when any disciplinary action will be taken.

Although each case will be different, the law maintains that all employers must act reasonably when carrying out disciplinary procedures. Adhering to appropriate disciplinary procedures is essential to apply to ensure a fair process is carried out.

Grievances are concerns, problems or complaints that employees may raise with you. Procedures should allow employers to deal with grievances fairly and consistently. It is best practice to have these procedures outlined in your staff handbook, so employees will know how to report any grievances that arise. To allow for grievances to be resolved quickly, it is best practice for these to be raised with the employee’s line manager in the first instance. Grievance procedures should make it easy for employees to raise issues with management.

When you draw up grievance procedures or disciplinary procedures your company must follow a fair, reasonable, prompt and consistent procedure. Getting these policies implemented is crucial to the long term management of staff. Sapience HR can help you to tailor policies to suit your business whilst ensuring all statutory requirements are met.
